These Terms of Service and Distance Contract Terms ("Terms") apply to the use of https://thejerky.world and to purchases made through this website.

By using the website or placing an order, you agree to these Terms and to the policies published on the website, including the Privacy Policy, Refund Policy and Shipping Policy. Nothing in these Terms limits mandatory consumer rights under Latvian or European Union law.

1. Online store and Shopify

Our online store is powered by Shopify. Shopify provides the e-commerce platform, checkout, hosting, security and related services. The sale of products is concluded directly between you and SIA SmartBuy. Shopify is not the seller of our products and is not responsible for fulfilment, delivery, product quality, returns or refunds.

2. Eligibility and accounts

You may use the website and place orders if you are at least 18 years old or have consent from a parent or legal guardian. When placing an order or creating an account, you must provide accurate, complete and current information. You are responsible for maintaining the confidentiality of your account credentials.

3. Products and food information

We sell sealed packaged meat snacks, including beef jerky, pork jerky, chicken jerky, beef sticks, pork sticks, chicken sticks and mixed meat snack boxes.

We make reasonable efforts to display product descriptions, ingredients, allergens, nutritional values, net quantity, prices, images and packaging information accurately. Product images may differ slightly from the actual product because of screen settings, packaging updates, lighting or photography conditions.

Before ordering or consuming a product, you must review the product page and the product packaging, including ingredients, allergen information, nutritional values, storage instructions, best-before information and any warnings. If you have allergies, dietary restrictions or health-related concerns, contact us before ordering if anything is unclear.

Nutrition claims such as "high in protein" or "low sugar" apply only where the specific product meets the applicable legal conditions and where the claim is shown for that product. Always check the nutrition table for the individual product.

4. Orders and contract formation

When you place an order, you make an offer to purchase the selected products. The contract is concluded when we accept the order by sending an order confirmation or otherwise confirming acceptance. We may refuse or cancel an order before acceptance if the product is unavailable, payment fails, information is incorrect, the delivery address cannot be served, fraud is suspected, or the order cannot be fulfilled for reasons outside our control.

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled order. You should review the order carefully before submitting it. After acceptance, changes or cancellation may not always be possible, especially after preparation, packing or dispatch.

5. Prices, taxes, markets and payment

Prices, taxes, delivery costs, currency and checkout options are displayed before you complete the order. Shopify Markets and checkout settings may adapt country, region, currency and language based on your location, browser settings, selected market or the URL you use. The final price and terms shown at checkout apply to your order.

Product prices include VAT where applicable. Delivery costs, duties, customs charges or other fees may be shown separately at checkout or charged by the destination country where applicable. Payment must be made using the payment methods available at checkout. We do not store full payment card details on our own systems.

6. Delivery

We ship to destinations and with delivery methods available at checkout. Orders are usually processed within 1-3 business days after order confirmation and successful payment. Delivery estimates are estimates only and may vary due to carrier workload, public holidays, weather, customs processing, address issues or other circumstances outside our control.

You are responsible for providing a correct and complete delivery address and contact information. For consumer orders, the risk of loss or damage passes to you when you or a person designated by you receives the goods, unless you independently arranged delivery with a carrier that was not offered by us.

7. Customs and import restrictions

For deliveries outside the European Union, you are responsible for checking whether the ordered food products may be lawfully imported into the destination country. You may be responsible for import duties, customs fees, taxes, inspections or other local charges. We are not responsible for customs delays, refusals, seizures, additional costs or non-delivery caused by import restrictions, incorrect customer information or local laws.

8. Right of withdrawal and returns

If you are a consumer, you generally have the right to withdraw from a distance contract within 14 calendar days from the day you receive the goods, unless an exception applies. To exercise this right, you must send a clear statement to info@beefjerky.world before the withdrawal period expires.

Because we sell sealed food products, returns are accepted only where the products are unopened, unused, undamaged, in original sealed packaging and suitable for return, unless the product is defective, damaged, unsafe, incorrect or otherwise non-conforming. Opened food products cannot be returned for health, hygiene and food safety reasons unless a legal remedy applies.

9. Damaged, defective or unsafe products

Please inspect your order after delivery. If a product is damaged, defective, unsafe, incorrect or incomplete, contact us as soon as possible at info@beefjerky.world with your order number, description of the issue and photos of the product, packaging and shipping label. Do not consume a product if you believe it may be unsafe or contaminated.

10. Product storage and responsibility after delivery

You are responsible for storing products according to the instructions on the packaging or product page. We are not responsible for quality issues caused by incorrect storage, misuse, opening the package, exposure to heat, moisture, contamination or failure to follow storage instructions after delivery.

11. Promotions, discounts and gift cards

Promotions, discounts, coupon codes, gift cards or special offers may be subject to separate terms, expiry dates, product exclusions, country restrictions or minimum order values. We may modify, suspend or cancel promotions where permitted by law.

12. Intellectual property and user content

Website content, including text, images, product photos, logos, graphics, layout and designs, belongs to SIA SmartBuy, our licensors, suppliers or content providers unless stated otherwise. You may use the website for personal, non-commercial purposes only. You may not copy, reproduce, scrape, sell, publish or use website content commercially without prior written consent.

If you submit reviews, comments, photos or feedback, you confirm that you have the right to submit them and that they are lawful and not misleading. We may moderate or remove user content that is unlawful, misleading, abusive, spam, irrelevant or otherwise inappropriate.

13. Prohibited use

You must not use the website for unlawful, fraudulent or abusive purposes, to infringe rights, transmit harmful code, scrape data without permission, interfere with security, impersonate another person, submit false information or misuse discounts, promotions or checkout systems.

14. Errors and availability

Information on the website may occasionally contain errors or omissions, including product descriptions, ingredients, allergens, prices, promotions, delivery costs or availability. We may correct errors, update information, refuse or cancel orders where information was inaccurate, including after an order was submitted. If payment has already been made for a cancelled order, we will refund the amount paid.

15. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, punitive or consequential losses. Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law, and nothing limits your mandatory consumer rights.

16. Force majeure

We are not responsible for failure or delay caused by circumstances beyond our reasonable control, including natural disasters, war, strikes, epidemics, transport disruption, customs delays, government restrictions, cyberattacks, technical failures, supplier delays, carrier delays or other events beyond our control.

We process personal data in accordance with our Privacy Policy and applicable data protection law. Please read the Privacy Policy for more information.

18. Changes to these Terms

We may update these Terms from time to time. The latest version will be available on this page. For orders already accepted before changes are published, the Terms in force at the time of order acceptance apply unless a change is required by law.

19. Governing law and disputes

These Terms and purchases made through the website are governed by the laws of the Republic of Latvia. If you are a consumer residing in another EU country, you may also benefit from mandatory consumer protection laws of your country of residence.

If a dispute arises, please contact us first at info@beefjerky.world. You may also contact the Consumer Rights Protection Centre of Latvia (PTAC) or another competent consumer protection authority. The European Online Dispute Resolution platform was discontinued on 20 July 2025 and is no longer available.
