These Terms of Service and Distance Contract Terms (“Terms”) apply to the use of the website thejerky.world and to all purchases made through this website.

In these Terms, “we”, “us”, “our” and “Seller” refer to SIA “SmartBuy”. “You”, “your”, “Customer” and “Buyer” refer to the person using the website or placing an order.

The commercial brand used on this website is The Jerky World.

By accessing our website or placing an order, you confirm that you have read, understood and agree to these Terms, our Privacy Policy, Refund Policy, Shipping Policy and any other policies published on our website.

Nothing in these Terms limits or excludes any mandatory rights granted to consumers under the laws of the Republic of Latvia or applicable European Union consumer protection laws.


1. Online Store and Shopify

Our online store is powered by Shopify, which provides the e-commerce platform that allows us to sell our products to you.

However, any sale made through our website is concluded directly between you and SIA “SmartBuy”. Shopify is not the seller of our products and is not responsible for the fulfilment, delivery, quality, return, refund or legal compliance of the products sold by us.

Certain personal data may be processed by Shopify as our e-commerce platform provider. More information is available in our Privacy Policy.


2. Eligibility and Account

You may use our website and place orders if you are at least 18 years old or have the consent of a parent or legal guardian.

When creating an account or placing an order, you must provide accurate, complete and up-to-date information, including your name, email address, phone number, billing address, delivery address and payment information.

You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account.

We reserve the right to refuse service, close accounts or cancel orders if we reasonably believe that false, incomplete, fraudulent or unlawful information has been provided.


3. Products

We sell sealed packaged food products, including but not limited to:

  • beef jerky;
  • beef sticks;
  • chicken sticks;
  • pork sticks;
  • stick mix;
  • party mix;
  • beef mix;
  • other related meat snack products.

We make reasonable efforts to display product descriptions, ingredients, allergens, nutritional information, packaging details, prices and images accurately.

However, product images may slightly differ from the actual product due to screen settings, packaging updates, lighting, photography conditions or supplier/manufacturer updates.

Before purchasing, you must carefully review the product description, ingredients, allergens, nutritional information, storage instructions and any other product information displayed on the product page or packaging.

If you have allergies, dietary restrictions, health-related concerns or specific food requirements, you are responsible for checking the product information before placing an order. If anything is unclear, contact us before purchasing.

We may update, change or discontinue products at any time without prior notice.


4. Orders and Formation of Contract

When you place an order through our website, you make an offer to purchase the selected products.

The contract between you and SIA “SmartBuy” is concluded when we confirm acceptance of your order by sending an order confirmation email or otherwise confirming that your order has been accepted.

We reserve the right to refuse or cancel an order before acceptance, including but not limited to cases where:

  • the product is unavailable;
  • the price or product information was incorrect due to a technical or human error;
  • payment was not completed or was declined;
  • the delivery address is incomplete, incorrect or cannot be served;
  • we suspect fraud, misuse or unlawful activity;
  • the order cannot be fulfilled for reasons beyond our control.

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled order.

You must review your order carefully before submitting it. After an order is accepted, changes or cancellation may not always be possible, especially if the order has already been prepared, packed or dispatched.


5. Prices, Taxes and Payment

All prices are displayed in EUR, unless stated otherwise.

Prices may include VAT/PVN where applicable. Delivery costs, taxes, duties, customs charges or other fees may be calculated and shown separately before you complete your order.

For deliveries outside Latvia or outside the European Union, you may be responsible for import duties, customs fees, taxes, brokerage fees or other charges imposed by the destination country.

Such import duties, customs fees, taxes and other charges are not included in the product price or delivery price unless expressly stated otherwise at checkout.

We reserve the right to change prices, discounts and promotions at any time. The price applicable to your order is the price displayed at checkout at the time you place the order.

Payment must be completed using the payment methods available at checkout. We do not store full payment card details on our own systems.


6. Delivery and Shipping

We deliver worldwide, subject to the delivery methods, restrictions and destinations available at checkout.

Available delivery methods may include, depending on destination and availability:

  • Omniva;
  • DPD;
  • Venipak;
  • Latvijas Pasts;
  • DHL;
  • FedEx;
  • UPS;
  • other delivery providers shown at checkout.

Orders are usually processed within 1–3 business days after order confirmation and successful payment.

Delivery times and delivery prices depend on the destination, selected delivery method and carrier. The applicable delivery options, estimated delivery times and delivery costs are shown at checkout before you complete your order.

Estimated delivery times are provided for convenience only. Delivery times may vary depending on the destination, carrier, customs processing, public holidays, weather conditions or other circumstances outside our control.

Under Latvian distance trading rules, if no other delivery period is clearly agreed, the seller must supply the goods within 30 days after receiving the order.

For consumer orders, the risk of loss or damage to the goods passes to you only when you or a person designated by you receives the goods, unless you independently arranged delivery with a carrier that was not offered by us.

You are responsible for providing a correct and complete delivery address. If delivery fails due to incorrect or incomplete information provided by you, we may charge additional costs for re-delivery.


7. Customs, Duties and Import Restrictions

For orders delivered outside the European Union, the customer is responsible for checking whether the ordered products may be lawfully imported into the destination country.

You are responsible for any customs duties, import taxes, brokerage fees, inspections, local regulatory charges or other fees charged by the destination country or delivery provider.

We are not responsible for delays, refusals, seizures, additional costs or non-delivery caused by customs procedures, import restrictions, incorrect customer information or local laws of the destination country.

If a parcel is returned to us because you refused to pay customs charges, failed to complete customs procedures or provided incorrect import information, we may deduct delivery, return delivery and other reasonable costs from any refund, unless prohibited by applicable law.


8. Right of Withdrawal for Consumers

If you are a consumer, you generally have the right to withdraw from a distance contract within 14 calendar days from the day you receive the goods, without giving a reason. PTAC states that, when buying from an online store, a consumer may withdraw from the contract within 14 calendar days from receiving the item, unless a longer term has been agreed.

To exercise the right of withdrawal, you must inform us by sending a clear written statement to:

The withdrawal notice must be sent before the expiry of the 14-day withdrawal period.

You may use a withdrawal form if available on our website, but using a specific form is not mandatory as long as your statement clearly confirms your decision to withdraw from the contract.


9. Exceptions to the Right of Withdrawal for Sealed Food Products

Because we sell sealed packaged food products, the right of withdrawal may not apply in certain cases provided by law.

The right of withdrawal may not apply to goods that:

  • are liable to deteriorate or expire rapidly;
  • are sealed and are not suitable for return due to health protection or hygiene reasons if they have been unsealed after delivery;
  • have been opened, used, damaged or handled beyond what is necessary to check their nature, characteristics and functioning;
  • are custom-made or clearly personalised, if applicable.

For food safety and hygiene reasons, opened food packaging cannot be returned unless the product is defective, damaged, incorrect, unsafe or otherwise non-conforming.

This does not affect your legal rights if the product you received is damaged, defective, incorrect, unsafe or does not match the order.


10. Returning Goods After Withdrawal

If your withdrawal is valid and the goods are eligible for return, you must return the goods to:

Unless we have agreed otherwise or unless the return is due to our fault, you are responsible for the direct cost of returning the goods.

Returned goods must be unused, unopened, undamaged, in their original packaging and suitable for resale, unless the return is due to a defect, damage, incorrect product or other non-conformity.

You are responsible for any reduction in the value of the goods resulting from handling them beyond what is necessary to check their nature and characteristics.

The consumer must return the goods no later than 14 days after sending the written withdrawal notice.

We recommend using a trackable delivery method. We are not responsible for returned parcels lost in transit unless the return delivery was arranged by us.


11. Refunds

If you validly exercise your right of withdrawal and the goods are eligible for return, we will refund the payments received from you, including the standard delivery cost paid for the original delivery, where required by law.

If you selected a delivery method more expensive than our standard delivery option, we are not required to refund the additional delivery cost.

We may withhold the refund until we have received the returned goods or until you provide proof that you have sent the goods back, whichever occurs first.

Refunds will be made using the same payment method used for the original transaction, unless we agree otherwise.

PTAC states that the seller must refund the amount paid without delay and not later than 14 days after receiving the withdrawal notice, but the seller may suspend the refund until the goods are received or proof of return is provided.


12. Damaged, Defective or Incorrect Goods

Please inspect your order as soon as you receive it.

If you receive a damaged, defective, incorrect, unsafe or incomplete product, contact us as soon as possible at:

Please include:

  • your order number;
  • your full name;
  • a description of the issue;
  • photos of the product, packaging and shipping label;
  • any other relevant information.

If the product is confirmed to be defective, damaged, incorrect, unsafe or non-conforming, we may offer a replacement, refund, partial refund or another solution in accordance with applicable law.

If the return is required because the product is damaged, defective, incorrect or non-conforming, we will cover the reasonable return shipping cost, unless another solution is agreed.

Your rights for defective, damaged, unsafe or non-conforming goods are separate from the ordinary right of withdrawal and are not limited by these Terms.


13. Product Safety, Allergens and Storage

Our food products may contain allergens or may be produced, packed or stored in environments where allergens are present.

You must read the product label, ingredients, nutritional information, allergen information and storage instructions before consuming the product.

You are responsible for storing the products according to the storage instructions on the packaging or product page.

We are not responsible for product quality issues caused by incorrect storage, misuse, opening the package, exposure to heat, moisture, contamination or failure to follow storage instructions after delivery.

If you believe a product is unsafe, damaged, contaminated or unsuitable for consumption, do not consume it and contact us immediately.


14. Promotions, Discounts and Gift Cards

We may offer discounts, promotions, coupon codes, gift cards or special offers from time to time.

Promotions may be subject to separate terms, including expiry dates, minimum order values, product exclusions, country restrictions or one-time-use limitations.

We reserve the right to modify, suspend or cancel promotions at any time, unless prohibited by law.

If there is a conflict between these Terms and the specific terms of a promotion, the promotion terms will apply to that promotion.


15. Intellectual Property

All content on our website, including text, images, logos, graphics, product photos, designs, icons, videos, layout and other materials, belongs to SIA “SmartBuy”, our licensors, suppliers or content providers, unless otherwise stated.

You may use our website for personal, non-commercial purposes only.

You may not copy, reproduce, modify, distribute, sell, publish, display, scrape, download or use any website content for commercial purposes without our prior written consent.

All trademarks, trade names, logos and brand elements displayed on our website remain the property of their respective owners.


16. Third-Party Links and Services

Our website may contain links to third-party websites, apps, payment providers, delivery providers, social media platforms or other services.

We are not responsible for the content, policies, security, availability or practices of third-party websites or services.

Your use of third-party services may be subject to the terms and privacy policies of those third parties.


17. Reviews, Feedback and User Content

If you submit reviews, comments, photos, suggestions or other content to us or through our website, you confirm that you have the right to submit such content and that it does not violate any law or third-party rights.

You grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, publish, translate, display and distribute such content for purposes related to operating, improving and promoting our business.

We may moderate, edit or remove user content if we believe it is unlawful, misleading, offensive, abusive, defamatory, spam, fake, irrelevant or otherwise inappropriate.

You must not submit false, misleading or fraudulent reviews.

We reserve the right to correct errors, update information, cancel orders or refuse orders if information on the website was inaccurate, including after an order has been submitted.

If your order is cancelled after payment due to such an error, we will refund the amount paid.


20. Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, punitive or consequential losses, including loss of profit, loss of revenue, loss of data or business interruption.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

Nothing in these Terms limits your mandatory consumer rights under Latvian or European Union law.


21. Force Majeure

We are not responsible for failure or delay in performing our obligations if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, war, strikes, epidemics, transport disruption, customs delays, government restrictions, cyberattacks, technical failures, supplier delays, carrier delays or other events beyond our reasonable control.

If such circumstances affect your order, we will contact you as soon as reasonably possible.


22. Privacy and Personal Data

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation, where applicable.

By using our website or placing an order, you acknowledge that your personal data may be processed for purposes such as order fulfilment, payment processing, delivery, customer support, fraud prevention, legal compliance and marketing where legally permitted.

The latest version will always be available on this page. The date of the latest update will be shown at the top of the document.

Changes apply from the date they are published, unless stated otherwise.

For orders already accepted before the changes, the Terms in force at the time of order acceptance will apply, unless a change is required by law.


24. Governing Law and Disputes

These Terms and any purchase made through our website are governed by the laws of the Republic of Latvia.

If you are a consumer residing in another European Union country, you may also benefit from the mandatory consumer protection laws of your country of residence.

If a dispute arises, please contact us first so that we can try to resolve the issue directly.

You may also contact the Consumer Rights Protection Centre of Latvia, PTAC, or use other dispute resolution options available under applicable law. PTAC accepts consumer complaints where a purchased product is non-conforming, goods are not delivered within the required time, or the seller fails to ensure the right of withdrawal.
